Section 1: Terms & conditions

1. Application’s Definition:

   These Terms & conditions, and privacy policy, “herein after referred to as (Charter)”, is exclusively related to Muzien electronic application, “herein after referred to as (Muzien)”. Muzien is an electronic application that has been established in the Kingdom of Saudi Arabia, with promising Saudi calibers, who seeks to prove themselves and to achieve success in the local and regional business markets, and works to serve their communities, and to facilitate the people daily life, and to change the concepts of the electronic services and entertainment. Muzien acts as a coordination link between two kinds of clients/users, 1) "Service recipient” and, 2) a group of grooming service providers and barbershops “herein after referred to as (Service Providers)”, in order to facilitate access between Parties, while providing multiple options related to quality, cost and time that suit each party.

2. Charter Content & Parties:

   Charter is deemed as an agreement between all parties, and the parties to this agreement are:
   - Muzien
   - The User who are divided into two types:
   1) Service recipient.
   2) Service Providers.
   herein after -both “Service recipient” & “Service Providers” referred to as User. Charter has been drafted with a high level of proficiency to ensure maximum transparency, and we advise you to read it carefully. Therefore, registration on the Muzien is not accepted until you have finished reading it, and by selecting the option “I AGREE” at the end of this window you undertake and agree to commit to Charter.
   After this procedure, an agreement -with entire legal effects- has been entered into force by and between Muzien and The User.

3. A Due Diligence, and Liability of Use:

   Dear User, use and access to Muzien is always subject to the terms and conditions set forth in this Charter, and the privacy policy contained therein, and by registering on Muzien you fully agree to all these terms and conditions, and must entirely comply with them. You also take absolute responsibility for ensuring that all persons who access Muzien via your internet device are also aware of these terms and conditions, and that they comply with them.

4. Freedom of Use, Offer and Acceptance:

   Dear user, if you do not wish to abide by and comply with Charter, you must stop using Muzien, stop accessing it, and if you are indeed registered on, you can delete your account as detailed in the privacy section of this document.

5. Financial Liabilities:

   1. For “Service Providers” and salon owners, independent contracts are handled with them stating the financial terms that concern them and in return of the benefit they obtain from Muzien services, and this Charter is an integral part of any ensuing contract.
   2. For “Service Recipient”, fees are required for Muzien, these fees are a charge for obtaining grooming and shaving services from “Service Providers” and their statement is as follows:
   1. Only appointment booking fees (application fees) are collected for using any of the services of our partners “Service Providers” displayed within Muzien, and these are variable fees that shall appear on Muzien exit window, (such determined by the Muzien Admin).
   2. As for the grooming and shaving services that “Service Recipient”, get from “Service Providers”, none of these fees are priced and/or collected through Muzien, as the responsibility for pricing and collecting these due money rests with “Service Providers” themselves, and Muzien takes no responsibility for pricing and collecting amounts Fees related to “Service Providers” are collected only by them, while the role of Muzien is limited to displaying those fees only to User -through the Application’s window- whenever possible.
   3. In every case, all due fees and financial obligations are non-refundable after payment.

6. Muzien’s liability limits:

   Muzien relieve itself from any responsibility towards everyone regarding any loss and/or damage of any kind, arising between Users each others, whether resulting from booking cancellation, delay, lack of quality, poor performance, and/or Service Provider’s failure to perform its service, or otherwise, as well as from any aggressive verbal and/or physical actions, and/or an act that violates the regulations, laws, Islamic religion rules, public order and public morals in the Kingdom of Saudi Arabia or any other country in which Muzien operates, whether issued by “Service Providers” or “Service Recipient”, whether it occurred inside or outside workplaces (beauty and barber salons). We hereby confirm that Muzien responsibility restricted to ensuring that Application’s window works properly, allowing service seekers to find service providers subscribed to Muzien, according to the potential search options, while all Users take full responsibility for his choices.

7. Intellectual property rights:

   Dear User, your use of Muzien, the services provided and the benefits you obtain from the Application, and your access to the information contained therein, does not mean in any way your right to the trade name, trademark, commercial designs, and/or intellectual property rights to Muzien, and anything associated with it and the creative ideas that emerge from its owners. Any attempt by you to infringe, simulate or transfer creative ideas related to Muzien and the services provided on it is considered an infringement on Muzien and its owners, and a violation of intellectual property rights that exposes you to liability. You declare, from the date of your access to Muzien and registration on it, that you have the entire knowledge that Muzien and its owners are first in copyright/intellectual property rights in this regard. You as well undertake not to use, publish, or otherwise deal with any of the set forth above without prior written approval from Muzien.

8. Owner’s Right Protection, and Muzien Content from Infringement:

   User may not, under any circumstances, try reverse engineer, alter, disassemble, translate, reproduce, simulate, copy or save any content or data from Muzien on their own software systems, or translate the Content into any other software language or Retransmit in any form or by any means (such as electronic reproduction, photocopying, recording, etc.) for any of the materials, information or content that was displayed, downloaded or managed from Muzien without the prior written consent of its owners.

9. Sanctions, Service Obtaining Rules, and Reservation Procedures:

   Muzien ensures for the good performance and the high quality of the service, and in order to observe the highest quality standards of reservations, cancellation and the App's management, that all transactions, responses, feedbacks and comments made by Users within the Application shall be subject to control, and careful monitoring by Muzien. Muzien has the right to delete any comment and/or feedback that does not comply with the regulations, the applied laws, the general morals, and/or with the provisions of this Charter. A strict as well criteria will be used to evaluate Users and their commitment to their reservations and publish them on the personal profile of each User, in order to achieve the highest level of transparency for Users and helps all Users to estimate their choices and modify their options. And in this regard, Muzien preserves the right to apply fines on Users that do not adhere to or violate the terms of Charter and the booking rules and appointment.

10. Banner Ads and/or The third-party Sources:

    As part of Muzien application funding sources, you may receive links from third-party sources -through Muzien application’s window-, such as advertising, marketing campaigns, an individual's own promotions..etc, all Users hereby, once accepting this Charter have acknowledged their full knowledge of that. Muzien relieves itself from any responsibility towards such Banner ads and/or the third-party sources content. If the user chooses to continue with any product or service from any of these third-party sources, this is his/her own sole discretion and personal decision.

11. Muzien Undertakes to:

    1. Strictly protect User's privacy and not to violate the security systems of any computer or network, including without limitation (directly or indirectly infringing copyrights, patents, trademarks, trade secrets or other proprietary rights or other intellectual property rights).
    2. Entire commitment to laws, regulations, governmental orders, and not to violate any of these, and/or state’s general policy in force in the Kingdom of Saudi Arabia or any other country in which Muzien operates or may operate.
    3. That every file sent by Muzien must not contain viruses, or any other programs or computer programming elements intended to damage or interfere with any computer system, data, and/or network, Muzien in general is impossible to participate in any illegal technical activities that conflict with our integrity, and the legal rules that control business.
    4. Must not provide any third party, our User’s “username” and/or “password”, or make any of them available in any way to any entity and/or person, and to take all necessary steps to ensure the preservation and confidentiality of the user names and passwords, and must not disclose them. However, each User must be legally bound and responsible for the actions and operations taken through his/her username and/or password, with reference to clause No 5. in the privacy policy section set forth herein.

12. Right of service termination:

    User violates Charter, practices one or more prohibited actions, or fails to comply with any of his/her obligations, Muzien has the right to take the following actions, without prejudice to any other legal rights:

    1. Suspend and/or block User from Muzien, prevent him/her from accessing this Application or suspend one or more of service for him, without prior notice.
    2. Notifying User to restore things to their original condition, and/or to repair - at his/her own expense- the damage, issues, caused as a result of his/her own mistake or violation;
    3. Charging User for any indemnification or costs incurred by User due to user’s mistakes or violations.

13. Jurisdiction and Governing Law:

    The terms and conditions of this Charter, including the privacy policy contained herein, will be governed by, and construed in accordance with the substantive laws of Kingdom of Saudi Arabia, and its courts shall have exclusive jurisdiction to settle any dispute or claim emerge from.

14. Severability & No Waiver:

    No failure or delay by a party in exercising any right, power or privilege hereunder shall operate as a waiver thereof, In case any provision in this Charter shall be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

15. Assignments:

    No User shall waive and/or assign any of his/her rights, obligations hereof without the prior written consent of Muza Muzien yen. Any attempt of waive, assignment in violation of this Charter shall be null and void.

16. User’s account & financial portfolio:

    After each User (recipients of services) creates an account on Muzien, a financial portfolio is automatically opened. Charter is deemed the future reference for your financial portfolio on Muzien, such working mechanism is as follows:

    1. User must deposit the necessary funds to fill the balance of your financial portfolio, in order to use it later in fulfilling the financial obligations related to the services obtaining from Muzien, such balance covers all future uses through automatically deduction from the balance of your financial portfolio in fulfillment of your financial obligations.
    2. After the necessary funds are deposited in your financial portfolio via any successful bank and/or electronic transfer method, it will be approved to appear through your account on Muzien that the deposited amount is available in your financial portfolio , and has been added to your balance in a valid manner.
    3. The funds that are deposited in your financial portfolio and added to your balance by Muzien as a kind of indemnification if the program crashes, or as a result of poor quality of service, or any issue by "Service provider", or for any other reasons of indemnification, such funds shall remain available in your financial portfolio balance for a period of “60” sixty days only from the date of deposit, and after the expiration of this period without expending them by User, it shall be withdrawn from the financial portfolio, without obligation Muzien to indemnify in the future for the same.
    4. The funds that are deposited in your financial portfolio and added to your balance by Muzien as a kind of User motivation to use the services available on Muzien, including but not limited to (special offers, discounts, or promotion for marketing services “called marketing credits” or otherwise), Such funds shall remain available in your financial portfolio balance for a period of (30) thirty days only from the date of depositing them in your financial portfolio, and after the expiration of this period, all balances dedicated for this type of use are deleted without notifying User directly, and without any responsibility on Muzien.

Section 2: Privacy & Policy

1. The privacy policy herein define the mechanisms of Muzien in control methods of Users’ data, including but not limited to (collecting, management, storage, circulation, disclosure, and/or the followed confidentiality standards by Muzien in this regard).

2. The data collected from users are as follows:

   1. User Profile

      While users go through the process of creating and/or updating their accounts on Muzien, we may use this process to collect their data, such may include name, email, phone number, personal photos, login name, password, address, birth date, payment details and/or banking information (including Relevant payment verification).

   2. Demographic Data

      We may collect demographic data about users, including data obtained via user surveys.

   3. Content

      We may collect information that users submit when they contact Muzien customer support or when they write comments, reviews, submit ratings, and/or complaints within the application. This may include notes, photographs or other recordings collected by users.

   4. Data generated when users obtain our Services

      This may includes Location Data that We collect, or precise or approximate location data from the User's mobile device once location option is enabled by the User, and providing authorization for that.

   5. Transaction Information

      We may collect transaction information related to the access to our services, such includes the type of services ordered or provided, order details, service delivery information, date and time of the provided service, the calculated fees, the time taken to complete the service and the method of payment. kindly be aware as well that if someone uses your promotion code, we may associate your name with that person.

   6. Access Data

      We shall collect data about how users interact with our services, as access dates and times, application features, pages viewed, application crashes, browser type, other system activity and third-party sites or services used prior to interacting with our Services. In some cases, we collect this data through cookies, pixels, tags, and similar tracking technologies that create and maintain unique identifiers.

   7. Device Data

      We also may collect data related to the devices used to access our Services, including device models, IP address, operating systems, versions, software, used languages, unique device identifiers, advertising identifiers, serial numbers, device motion data, and mobile network data.

3. Kindly know, that all data collected from users is a procedure done for the purpose of correctly and legally defining the user’s identity, protecting all parties dealing with Muzien against fraud, and impersonation other people and characteristics, and to facilitate the process of communicating with real people. Such also shall smoothly provide all users with the application services and facilitating its management, provide the best browsing experience for the user, help us to handle users’ subscriptions carefully, conduct financial transactions, and address technical problems correctly.

4. We ensure that all collected users’ data, stored and/or analyzed for the purpose of using Muzien services is untradeable and should not shared with any third party without the prior consent of the users themselves, taking into consideration the provisions of point 16 set forth below.

5. User hereby acknowledges that" user name" and "password" used to access any activity on Muzien or to display its services are his/her own personal responsibility, and Muzien must be notified immediately via the contact information of Muzien, published in the contact information section, in the event that they are lost or forgotten, or if their confidentiality is exposed to danger, or in the event of any restrictions, obstacles, or Fraudulent attempts against any User to prevent him from accessing the service and/or the content of this application.

6. Muzien undertakes to follow the highest levels of data security and protection procedures, and not to allow or ease other sites, platforms, or applications to steal, hack, or access the data of Muzien users.

7. Muzien application undertakes to save the users data in a completely secure manner after submitting it voluntarily, provided that access to this data and information is limited to individuals working under Muzien management or other permitted third parties after ensuring that they are subject to confidentiality obligations, and to follow the best encryption techniques to protect data when recording, sending and, or exchange with the server.

8. Each user has the right -at any time- to delete his/her account on Muzien, through the deletion options available within the settings window, the deleted account and profile data shall be kept Muzien server for one year after deletion for security purposes or for the request of the competent government agencies, after which the data is permanently deleted.

9. Each user as well has the right to deactivate his/her account for a certain period, without deleting it, and as a result, services will not be activate on this deactivated account, and it will be hidden to all, provided that in the event that the account remains unactive for a one year, then Muzien is entitled to permanently delete the deactivated account or keep without charge or obligation.. This provision also applies if the account is not used for the same period.

10. Muzien may -from time to time- conducts a legal and technical review of this Charter (terms and conditions of use & privacy policy), as well as an independent technical review regarding security procedures and means of protection on an ongoing basis, in order to keep pace with developments in the methods of providing electronic services, and developments in various software engineering or to respond to changes in the data quality requirements. Muzien also has the right to amend some or all of this Charter (terms and conditions of use, and privacy policy). Kindly know that the date provided at the bottom of each page of this Charter will be the date of the last update made to Charter. We also invite users to regularly follow this Charter to stay informed of the latest amendments and to know how we are protecting their personal data. Once user reads this provision of Charter, he/she undertakes that reviewing amendments and updates will be part of his responsibilities without necessity of prior notice from Muzien.

11. Muzien currently doesn't use "cookies", however once its available due to work necessity or for the purposes of improving the experience of using the website - if any - the internet browser therefore will usually insert these files on user's device in order to save some user's use information. Kindly know that such a procedure may lead to some pages or site's features being affected. Muzien -in this regard- is committed to providing user with the options to reject or accept the use of “cookies” once they are approved and launched, and not to activate any of the cookies unless they are notified.

12. Contact & Communication data collected from User may be used to send updates, alerts, promotions, and marketing offers, by subscribing to the appropriate choice for that, and User has the right at any time to unsubscribe from receiving such notifications at any time by deactivating the subscription button.

13. We do not have the right to use the data collected by Muzien for any purpose other than those stipulated in Charter and agreed to by our users or in advance.

14. Muzien has the right to use the user's collected data without a prior consent of User in the following cases:

    1. To comply with laws, regulations, resolutions, Judicial orders, judgments and/or or in compliance with the orders of the public authorities. in any of the countries in which Muzien operates.
    2. To share data in an anonymous manner for technical reasons with third parties in order to manage Muzien operations, solve the technical issues, improve the performance of the application, and/or make the necessary improvements to the server.
    3. To share data and information with third parties for the purposes of taking the necessary digital security measures, ensuring that user's data are being safe, ensuring that payment systems are secure and/or processing the payment of financial obligations through digital payment service providers.

15. Once you agree to this Charter, and register on Muzien, you therefore have given a prior permission to Muzien, and you have become aware of the following provisions:

    1. Muzien shall has the right to share your data with any third party -which the service providing, and the operation of the application requires cooperation- including but not limited to banks, financing entities and/or companies providing electronic payment services...etc.,
    2. Any third party is permanently subject to - as much as possible - continuous monitoring and following-up by Muzien, so that we ensure that there is no suspicion that the third party is misusing this data or violating the privacy of Muzien users.
    3. Should the third party is a new purchaser to whom ownership of the application will be transferred, and/or if Muzien -at any time- shall has to undergo a merger or acquisition, in this event Muzien ensure to User that any agreement shall include a clause obligating third party to respect Charter (the current privacy policy and terms and conditions of use), and not to modify and/or prejudiced without the prior consent of user.

16. We in Muzien believe that our users and clients are our success partners, therefore we welcome communication with us through our contact information, to receive all your suggestions, recommendations and/or complaints - if any - regarding Charter (terms and conditions of use & privacy policy). Your recommendations as well about encryption protocols, are highly welcomed and appreciated whether it’s related to data transferring, storing data and information or other privacy protection software such as virtual private networks (VPN) and/or everything new in syber space field, and secure browsers.

17. This Charter was divided into two parts 1)-Terms and Conditions of Use, and 2)- Privacy Policy, and it has been drawn up in both Arabic and English language. In case of discrepancies between the Arabic text version of this Charter and any translation, the Arabic version shall prevail.
